If 16 is the legal age of consent in BOTH states, then yes it is perfectly legal. If it is legal in only one of your states, then NO it is not legal, because the act occurs in BOTH states and BOTH states have jurisdiction.

This is the same way sex tourism works. When you're traveling or acting abroad, you must follow the laws of BOTH your home state and the visiting state.

First, they need to be reported to the police. Then the police need to discover evidence to support that report. If there is enough evidence, the police will then submit that evidence to a prosecutor who will determine if they can move forward with a charge.

Then the police can arrest your friend if the prosecutor agrees that a case is actionable. Then they go to court, a judge determines if the case is triable, and then your defense lawyer protects you.

It's a long process and the vast majority of sex crimes are not triable because there isn't enough evidence to do so.

I guess it really depends if you act on it or send pix to each other. There are lewd laws that might apply. Same ones that say you can't show a playboy mag to a minor. Corrupting a minor type things.

If the age of consent was 16 in both your states but you were still going across state lines, it's still a federal manner.
