Both were retards, that said it's the officer the one that has absolute power and authority. You can't afford having enforcing agents being retarded, and there's not much you can do about civilians having panic attacks and failing to follow instructions. A suspect being sloppy is expected, an officer being sloppy ends up with dead innocents.
