He's a comic character, but he was largely forgotten by the time JL aired and his backstory in the show was completely different (most of which got retconned into the comic character later on.) If they wanted to stick to the comics at the time, it would have been Kyle Rayner, but Kyle sucks and GL without the core (who were all dead at the time) is shit so they made the right decision.

The no-kill rule is an autistic in-story explanation for the self-imposed censorship American comics went through in the 50s. Also, it's easy to have a no-kill rule with writers as you own personal angels in the outfield making sure you are never put in a situation where you have to kill.
If we can accept Cobra troops always parachuting to safety, we can accept that Batman always punches his opponents into unconsciousness and not make it some huge act of moral supremacy.
