It's a known fact that when eyewitnesses describe a suspect they're oftentimes not accurate. The guy probably just got a little paint in his ears as well as other places. When the little girl gives her description, she remembers specifically the paint in his ears and the scars as the most prominent features.

I think he's stupid, but it's an easy mistake to make. Rust shooting the gun didn't make sense to the plot. It was interpreted by most as him shooting at God and the universe. A kind of metaphor for how upset Rust was with world and what it had done to him.

Rust and Marty discussed wanting to go after the Tuttles further. But they decided it wasn't possible to get them all and that killing the main murderers and child abductors was good enough.
