Intoxication is often treated as an aggravating factor, rather than mitigating. If it's a crime of "specific intent" such as murder you can rely on it to mitigate the mens rea, but the rule is "drunken intent is still intent." So if you're drunk and kill someone, if you were so drunk you did not form any intent to do so, you can escape with lesser charges. But if you get drunk and decide to kill someone, when you otherwise would not have made such a decision when sober, you're still guilty of murder. The alcohol may have influenced your intent, but you still had that intent.
In crimes of basic intent like assault or rape, you can't rely on intoxication at all.
A lot of this is shaped by public policy. It'd be a terrible idea to let people escape punishment just because they get wasted.
