Because, as Hesh said, "his lawyer said the gun charge will not stick!" We don't know more beyond that. There are several times in the show where characters should've gotten busted. Two involving Christopher were when he shot JT in his apartment, and when he hit the waiter in the head with the brick before Paulie shot him.

What Season had the better ending? 5 or 6?
With 5, you can just assume that Tony takes over all of New York and eventually passes the business onto Chrissy or AJ or someone. But with 6, you have to guess if Tony gets straight up murdered or not.

Chase explained all the pieces to understanding the last scene are in the last season, and more specifically the last 6 episodes. Which is why the last season was split up the way it was.

Clues that Tony Died.
>The Bobby and Tony scene about never seeing it coming.Foreshadows Tony's death and not Bobby's cause Bobby 'that fat fuck' Baccalieri saw his death.
>The Silvio Restaurant hit scene. He doesn't even realize what events happened. He just notices his blood without realizing someone had been shot.Further foreshadowing that no one notices the second before or when it happens, just after.
>The entire last act of the finale with Tony acting unaware. Like when he visits Junior and doesn't notice the person behind his shoulder calling for him to move.

Those hints and more are set up in the episodes all leading up to the finale. That plus the Pavlov's Dog effect that the last scene is filmed with and the fact that Chase originally wanted the entire credits to just be a silent, black screen; it basically points to that Tony got whacked.

The real mystery is who called the hit on Tony after the War had ended between the Families?
