The FBI is well within their rights to investigate, but, until now, they have never announced to Congress or the Public that they've been conducting an investigation until AFTER charges have been filed. They haven't filed charges against her yet, and they might well not do so, regardless of whether she wins or loses. It was clearly a partisan move by Comey to hand Trump the election.
