It seems more like the only person in this entire equation who's actually doing his job is Batman, who successfully turns in the Joker while also defending his right as an American citizen to a fair trial. Batman offers Joker up on a silver platter to the legal system and the people of Gotham and the great state of New Jersey, they drop the ball on all of their duties and responsibilities, and somehow this is Batman's fault?

Also Bruce being crazy enough to unravel at murder and go on a rampage is legit. The man planned ways to take out every person he knows, ways that could easily be tweaked to be fatal. He also created Brother Eye, used Venom in the past, and has shown that at times that one of only things keeping him from murdering every one of his rogues is Jim would hunt his ass down with or without the league's help. He has even tempted his friends to kill and offered to look the other way.

If you're gonna do a "realistic" superhero story, it has to have a direction and an ending in mind. All the status quo rules and storytelling conventions people bitch about, such as the Joker not being able to die, were created BECAUSE you need rules in a shared universe with no ending.

Once his body count got that high, there's not a lawyer in the world who could convince jurors to spare him the death penalty, especially since Joker doesn't actually meet most legal definitions of "insanity". HOWEVER, is the correct answer. Joker has more plot armor than anyone in comic history
