Okay I get that Gotham is a fucked up place and that's probably the best argument, but just take the chances.
Batman was probably going to kill Joker, but Superman stopped him. Isn't grieving for literal decades enough? Why would anyone hold Batman not betraying everything he stands for in a fit of rage against him? Not always, in fact there are more cases of Batman doing anything at all about Joker than anyone else yet everyone is content to act like he's done nothing while letting dozens of issues go by aware that Joker is out there and not enacting the supposed final solution they claim they would.

Batman is wrong for allowing the Joker to murder countless people. Jason was wrong for not just mag dumping into the base of the Joker's skull before Batman got there. His little pity party just allowed Batman to sign the death warrant of thousands of future victims.

Jason, easily. See before Nu52, he was a monster in the same vein as the rest of Batman's villains. The only difference is that he justifies it by saying his victims deserve it.
Batman refuses to kill or allow things like Joker to unlawfully executed as if the villains are chaos, he is order. Even though he knows the law is not perfect, he will abide by it the best he can. Killing someone or allowing them to get killed when he can avoid it is something he won't do as it breaks the code he has assigned himself. See, despite Snyder's retarded ideas about Joker, Bruce and him share nothing in common. That 'bad day' is all bullshit that Joker tells himself to make Batman the same. However, Bruce knows that killing one person would make it easier to justify killing another. After killing Joker, why not Ra's? After all, Ra's has just as much blood on his hands? What about Harley? She followed Joker and is a sick maniac? Ivy? Her powers make a threat to everyone. It can quickly snowball and very easily.
Another reason he doesn't kill is that Bruce wants to be a good person and inspire Gotham to be better. Subverting or breaking his own code isn't a good way of setting an example or convincing people to be better.

before nu52 jason was DC's take on the punisher more or less. there were several instances of uneven characterization like 52, battle for the cowl, and nightwing, but i attribute a lot of jason's mishandling to editorial not knowing what to do with him. similar to tim now. also batman was totally in the wrong. i never want to read a joker story ever again. especially by snyder.
