True story. I know a 14 year old boy. he was so proud to have his first real gf. She was a very young-minded 16 y.o. They, of course, didnt last long. Just puppy love. Months after they were no longer "dating" the girls father found pictures on her cellphone. The boy and girl had been sending each other nudes. the father called the police. Now, the boy is 15 and HE has to go to teen court but the 16 year old does not. The exchanges were mutual and he was under the age of consent. The police said they believed the girl, who blamed the boy for "coercing her", even though the first pic sent was from the girl.
As someone invested in the well being of this boy I am FURIOUS that he has to have his puberty years traumatized by the police and courts. It is, imo, absolute bullshit and extremely unfair. How is it possible for a boy under the age of consent to be charged while the girl of consent age is not????????
I understand the importance of teaching kids to avoide transmitting risque images due to adults and the internet. It is bullshit however to punish kids going through puberty WITH EACH OTHER because of what perverted adults do!
My rage against the father of the father of the girl and the police know no bounds. This is utter bullshit that could label the boy, traumatize his normal sexuality, and paint a target on his back in the coming years where any accusation against him from a female will be believed and the punishment will be severe.
We as a society really need to take a hard look at how we are treating our children in the name of protecting them.
Our child pornography laws were written in the 70's and 80's. They only ever assumed that someone taking the pictures would be a pervert with a Polaroid. They never realized there would come a day with virtually everyone has a camera, is willing to use it all the time, and is willing to use it to send nude pictures of themselves willingly back and forth.
The laws absolutely need to be updated to account for underage willing parties sending nudes to one another.
Its important to note that in some cases, there is no discretion for the judge/prosecutor. This sucks as well.

Court system has been shown time and again to discriminate against males. They're more likely to be convicted and more likely to have a harsher punishment for the same crime. In crimes involving a man and a woman, the man is most often picked out as the perpetrator, and woman simply as being pressured into it.
So his boy sent nude pics of his own sick accord, and the girl was simply pressured to respond back with nudes in kind. Its not her fault, if only the boy had not sent nudes in the first place this wouldn't be happening.

As a burger in Japan I always get the impression that one of the biggest differences in law enforcement is that in the USA there is pressure for LEO's to arrest and charge whereas in Japan there is pressure to settle issues without arresting and charging. Like for example if the cops get called for a fistfight they might take the participants to the station and interview them and the witnesses to find out what was happening, and then they will try to get the less-culpable party to agree to drop charges in exchange for payment of medical bills. And so then if they cooperated neither party would have an official arrest record.

this is absolutely true, Japanese civil trials also see more efforts at reaching a resolution outside the courtroom. A lot of it goes back to bakufu days and village/han ties, internal settlement of dispute etc., system continued through Meiji and imperial era, up through the present day. Eastern culture in general take the 以和為貴 approach; it's better to try to sort out issues between parties privately and quietly than drag them into open court.
Interestingly, western legal systems are moving more and more towards this approach as well.
It's an imaginary "problem". Nude photos hurt teenagers less than doing a marijuana. Obviously you can't change the society that perceives a naked image as life-ruining overnight, but changing child porn laws to focus on the production, the coercion, abuse, child rape etc. rather than the possession, transmission, receipt etc. would be a big first step.

An American prosecutor will bring a case they think needs to be prosecuted, even if they think the jury might wrong let the accused go. A Japanese prosecutor WILL NOT risk it. In a country where most prosecutors have never lost a case, and most defense attorneys have no wins, and face is king, having that defeat on your record is like tattooing "FAILURE" on your forehead.
This can mean that police and prosecutors simply let guilty men walk because they won't confess and there's a chance the judge will find them not guilty.

Teenage boys are very interested in the following:
1. Sex. Sort of like teenage girls. But whereas teenage girls are told by the culture at large that it's okay to explore their sexuality, we have some very odd, dark elements in our educational system that see male sexuality as a sort of loaded gun, only meant for hurting others. You should look at what they teach boys in sexual education nowadays. It is basically Rape Hysteria 101.
Did she drink? Then it was rape. Did she take cough medicine? Rape. (Yes, this actually happens.) Did she tell you yes, but then seem nervous at the time, and you didn't bother to ask her again? Rape. Did you not know she had been drinking? It's still rape. Did she say yes after some persuading on your part? Didn't you know seduction is rape?
There's definitely an element in our culture that just assumes male sexuality is inherently harmful and dangerous, and it's a strong enough element that it comes through in our policies and scars a lot of young teenage boys.
2. Fighting. Of course, boys should be disciplined out of this, and should face punishment if they engage in fighting. But nowadays the way they treat fights, boys are likely to end up in prison or with a record for engaging in some very natural urges.
