I remember all those PS1 games I bought on PS3 that I used on my PSP, and then later my Vita and Vita TV without having to rebuy them, and I could even copy the save too. Why can't Nintendo do that?

If you're marketing it as a home console, then you better be prepared for people comparing it to other home consoles. Especially consumers.

No, not using online doesn't send them a message that paid online is bad it sends the message they have nothing to lose and more money to gain because console sales aren't impacted by the extra cost.
