Even if no returns are accepted, you can file a claim with ebay if the product isn't as described. Just say it's broken. They'll either have to refund you or take it back, no choice. Ebay will force them.

Then send them something else back, keeping the Switch. Your word vs theirs, you win by default because you're the buyer.
