I don't have a problem with Nintendo wanting to protect their copyrights. Legally they're allowed to.

It's the thought behind the DMCA takedowns, though. They're not doing it for copyright protection. they're doing it because they don't like the idea of good games that aren't selling amiibos or microtransactions or DLC. Even if an internel dev was working on the Metroid 2 remake with nintendo's permission, they'd immediately throw it out for being too video gamey and not having enough day 1 DLC and amiibo support. Same with Pokemon.

Nintendo is a bit of a control freak in this way. Shoot, they thought they had the sole rights to entire genres, and attempted to strongarm people against doing anything to the genres withtout their permission. They even sued people like the guys behind game genie.

Because they understand that they have filled a niche. They don't want to allow anything that threatens their position if they can.

It's difficult for you. Those fangames and romhacks aren't hurting anyone or any potential sales. And if they are, maybe that says more about the company than the creator of those works. SEGA knows talent when they see it, and even encourages it, Capcom even took that Mega Man x Street Fighter fangame and made it an official release (albeit to their own laziness). Only Nintendo of America (keyword, not NoJ) feels these are actually going to harm their brand. If it's an actual issue, get to making those games people want. There's obviously a demand for them, and they'll find a way to scratch that itch, one way or another.
