Emulation is 100% legal in the eyes of the law, and that includes for-profit emulators. Sony tried to take two different companies to court for them back in the day and lost both times, so a precedent has been set

As long as you completely reverse engineer it yourself without stealing any secrets, it's legal. Otherwise a ton of software companies would be sued for 'stealing' ideas. What Nintendo could do is take them to court and claim they're stealing their market, damaging nintendo, etc etc. I'm not sure how strong of a case they'd have at that, I'd imagine very poor since you mostly can't do shit with cemu.
Even if nintendo loses, they put a huge financial burden on them during the time in which most people will stop operations immediately despite most likely being able to counter sue.

literally everything you see in emulation is someone going "what if" to a nth dimension and figuring out exactly what a console does.
It has DRM now. Basically it records the person's hardware info, if your PC doesn't match it then it won't start.

And money has nothing to do with it, emulators aren't defended under "fair use" (which typically involves not-for-profit use as a necessary but not sufficient condition), they're just legal. You cannot "own" as IP the ability to read a certain software format, it simply doesn't work that way. If someone else figures out how to read a software format using their own work, they own that work.
Technically the CEMU devs have copyright (whether or not they choose to exercise it) on CEMU's code, and thus its ability to play WiiU games. If you copied CEMU's codebase without permission, CEMU could sue your emulator easier than Nintendo could.

I know this is going to be an unpopular opinion but I'm not 100% in favor of this. I'm a hardcore advocate of the PC, but that's really not Nintendo's cup of tea. For them to be be working on emulating the switch right now.. I can't help but feel like it's not about keeping games alive, but simply piracy at this point.
I'm not a fan of console exclusives, but it's a way of life, and it's almost a necessary evil. As gamers, we owe something to the console business.. it's accessibility has driven the boom in business that has created such a huge market for games. We wouldn't be seeing the quantity / quality of games we see these days with out them.
Attempting to emulate a first party only title, arguably the only major selling point to the platform at the moment, from day one can't be seen as anything but detrimental to the future of Nintendo. Would I love it if I could play Zelda in gorgeous 4k? Sure I would... but Nintendo has gone a different route and tried to add something to gaming here with the novel portability of the Switch. Those two things are unquestionably not compatible in the small form factor they went with.
Emulating this just feels down right wrong to me... I love Emulators that promote saving games, etc that are going the way of the dinosaur. This is a very different thing to me.
