Possibly? I'm not sure the precedent of being able to be sued for getting a dev kit from a third party, but maybe.
I doubt they could be sued for developing an emulator though. Emulators, by themselves, are legal, and companies as big as Sega have used open source emulators to rerelease their games all the time.

I know, it's piracy, but here is the thing: People will usually take the shortest and most effective path that leads to rewards. For example, instead of working for 3 years in order to be able to buy a car, someone might prefer to just steal one instead. They might change their mind if they realize that it's extremely risky and that they could go in jail for much more than only the 3 years they'd otherwise need to spend (while free) to buy one.
It's the same with piracy. People can spend $200 to buy a Wii U, or they can donate $4 a month and get to play on their computers with the promise of better resolution and framerate too. It's just much more effective than spending the $200, there are more benefits to it too. The only disadvantage is that it's much slower, which is what makes some people just buy the console instead of doing piracy.
