In the end, you're playing on a Microsoft platform on both.
Emulation is technically protection of information whereas roms are technically piracy because with emulation you already have the hardware, which is what you buy a console for, so its just allowing software to run on it when emulating, as most emulators dont have the software of the console (unless you really wanna count the bios being used to just run the game) . So if you can source the roms yourself (i.e PSX2 lets you play games from ps2 discs) thats legal. Wheras roms are obtaining software you didnt pay for.
