They know it and it jives with the theme of the game.

Yeah I'm watching meet the sniper and there seems to be enough differences that it wouldn't be considered infringement at least in my eyes.

Obviously Valve deals with this kind of thing often enough that their legal team advised them against it. Unfortunate and disappointing. But understandable in today's climate of blood thirsty copyright.
