I've never understood the whole thing with this. Did Blizzard seriously not keep a fucking copy of the original source code? It literally existed only on a disc that got lost?

Besides simple stuff like art changes, modding a game requires changing the code.


You can either reverse engineer it with hex editing and shit which will take you a very long time, or use the source code and makes changes to things in no time at all.

Probably some dev got it home and forgot about it. Since they've made the remake and 1 patch recentrly, I assume they have the source code, they just don't want it public so others won't be able to export the remake files and use them on modified original client or something.

The code is not his. He was in possesion of disk, but that doesn't make him the copyright holder. Even if he sold the disk, he sold it without the approval of copyright holder, which is ActiBlizzard

Yes because it obviously was fucking stolen; if you're trusting somebody with the Starcraft GOLD SOURCE CODE, I think it's pretty clear that they were pretty high up the corporate ladder and didn't want the code to end up in a garage sale.
If Vincent Van Gogh (Blizzard) had a painting (Starcraft Source Code) hanging up in his house (Blizzard's headquarters), went to sleep, woke up to find it missing (stolen), then twenty years later heard that painting was at a garage sale for 20$, it still fucking belongs to Van Gogh, it doesn't matter how many times it was exchanged.

That's exactly what the first-sale doctrine protects. He'd be allowed to sell the disk regardless of who owns the copyright of it's contents. He's just not allowed to release the code. But he wouldn't be liable if the person he sold it to released it.
