I think the licensing issues are more to do with the soundtrack and the licensed cars in the game. Those licenses expire after a while and it costs a fortune to renew. Probably why Forza 2, 3 or 4 aren't BC.

SC IV was originally on the list of games to be backwards compat but for some reason they never brought it in. I know it may be a namco bandai thing but souls is already there so I don't see an issue of it being the publisher.
