You give them your IP when you connect to their website (otherwise they wouldn't be able to give you the website). And you give other people your IP when you're torrenting (otherwise they wouldn't be able to give you the 100% legit and legal software). They just pretend to be peers to a bunch of different torrents and register each IP that tries to download that torrent, then they just make a list.

No, because it's not hard evidence. IP connections just means that somebody used your internet connection to connect, it could be anybody in the residence or even somebody who connected via vulnerabilities from outside or something. And I think technically you could connect to a torrent without downloading/uploading anything, and in some cases it's not illegal to download just to upload, and there's no real way to measure that considering there are methods to spoof that.
