Folders with the same names don't merge, it just deletes the old one and everything in it.

You can set it to auto hide.

You can move it to the sides, autohide it, or remove it completely

I didn't like the performance of Sierra, so I hope this is like El Capitan or Snow Leopard (I miss those days).
I'm sure APFS will add performance gains because you can now do parallel copying compared to HFS+.

If by terminal shenanigans, you mean clicking a box in the settings panel, then yes, you can hide it.
That's hiding it. To get rid of it entirely you need terminal
It's best to just autohide it and move it to the side.
I'm on Sierra here, it only sometimes asks to Merge or Replace. When it doesn't ask, it still deletes the old contents.

Proper dark themes will never happen because app devs are lazy cunts. Even if OSX has a dark theme, expect every 3rd party program to look shit with it.
Same thing happens on Linux. Dark themes look like ass because of poor application design.

No, not really. I'm on a Sierra hackintosh and there's nothing different besides Boom 2 not working, being nagged to turn on 2FA until you do only for it to not fucking work half the time, oh and of course Siri.

Microsoft had to nigger-rig another company's userland into Windows to get a decent shell. No such problem on macOS. Just one of many examples of how macOS is actually fantastic for developers and system administrators.
