Well the problem is that the concept of copyright exists at all. It shouldn't, "intellectual property" is a contradiction in terms. The GPL is just a hack to try to use a bad system for good, instead of for evil like it normally is. So while it's inelegant and we shouldn't need it, we don't live in an ideal world.
