He was trying to settle a bargain deal by getting Harley to sleep with the guy. I think the guy got afraid when he asked Joker "is she yours?" or something and therefore felt bad if he did bang her but then Joker not being in his right mind took this as some offense or something and shot him.

no, they got rid of it because the mud partially obscured the "Damaged" tattoo. That was part of Leto's contract, the "Damaged Tattoo couldn't be obscured.
If they'd left that shot in the movie Leto wouldn't have done any promotion for it.
