Batman doesn't oppose the law beyond being a vigilante. If the Joker was put to death (and wasn't framed and his survival was key) then he'd feel that justice is finally done. The problem is that the law doesn't work the same in the DC universe.

It's more the fact that because DC is going to continue selling comics with the Joker, the Universe will always bend towards that result. Laws, characterization, common sense, everything will make the Joker survive.

Well yeah that's the out of universe reason why the Joker will never be killed. Even if he is killed he'll be brought back some way.

In universe reason is that Gotham's laws are fucked up to the point where the police have to rely on a guy in a batsuit bringing in crazy mass murderers on a daily basis so they can escape and repeat the cycle.
